
A Louisville family filed a lawsuit Monday against Wal-Mart, claiming they found a dead mouse in a milk container they had been drinking from for three days.
The lawsuit, filed in Jefferson Circuit Court, alleges that Robert and Rosalind Grant as well as their 23-month-old granddaughter sought medical attention and treatment in May after finding the mouse.
The child had blood in her stool as a result of drinking the tainted milk, according to the suit.
the suit also claims the Grants have suffered embarrassment, humiliation and emotional distress.
Claims made in filing a lawsuit present only one side of the case. A call to Wal-Mart officials was not immediately returned.
According to the suit, the Grants bought the milk at the Sam's Club - which is owned by Wal-Mart - on May 1 at 1401 Alliant Ave. and the container hadn't been tampered with. On May 5, the family opened the milk and drank from it for three days before Rosalind Grant "discovered a dead mouse" in the container, the suit says.
A manager at the Sam's Club declined to comment and referred calls to Wal-Mart.
The suit is seeking compensatory and punitive damages and a trial by jury.
